Basic Requirements and Advantages:
An advanced degree (degree above a bachelor degree) in the U.S. or a foreign equivalent degree or a baccalaureate degree plus 5 years progressive* work experience in the field.
Labor certification and a permanent, full-time job offer required, unless category is pursued in conjunction with a national interest waiver.
Are You Qualified?
You’ll need to possess an official academic record showing that you have a U.S. advanced degree or a foreign equivalent degree, or an official academic record showing that you have a U.S. baccalaureate degree or a foreign equivalent degree and letters from current or former employers showing that you have at least 5 years of progressive post-baccalaureate work experience in the specialty.
Frequently Seen Pitfalls:
For employee: Failure to adequately demonstrate that the foreign degree is equivalent to an advanced degree in the U.S. or failure to demonstrate five years of progressive work experience.
For employer: failure to maintain the ability to pay the offered salary, which will be required by USCIS when I-140 is filed.
